Financial remedy order states mortgage free property to be sold and both parties to have conduct of sale
The advertised price recommended by 3 independent estate agents is offers over £325,000. The property has had very few viewings despite being put on open market around 11 months agoThe matter has been complicated due to the ex having a non mol against friend (which is due to expire in a couple of months), however there is also an occupation order in place allowing her to remain living in the house until it is sold.As friend has not stepped foot in the house for 3 years he hasn't a clue as to its condition. Ex reluctant to allow/agree to estate agents request to take new photographs.Around 3 months ago ex tried to pressure friend into accepting an offer of £310,000, however as friend was awaiting legal advice he couldn’t agree within a very short imposed deadline (a matter of days) and the offer was withdrawnAfter receiving legal advice friend suggested the property be marketed at offers overs £315,000, but ex then insisted that the price remained at offers over £325,000.Believe ex’s lack of cooperation is a deliberate ploy to remain living in the propertyGiven the above circumstances can I please have advice on how my friend can proceed/enforce the financial remedy order.Thank you
