Hi I am trying to get the ball rolling for my sister here is some details and facts on the situation if anyone can help please

She divorced her ex over 20 years ago, she had paid all mortgage payments for her solo account and brought up 2 kids of his without any financial assistance

Now she is looking to sell the house, he has popped up now there is equity in the house, even if his name is on the mortgage from 20 years ago which o understand has some claim


Can anyone tell me how to get the ball rolling with regards to contesting to his entitlement to any equality in the house and the first steps and costs etc

as a side not there is a high chance he won't even attend court don't know if that helps


Any knowledge on this situation is appreciated

One of the parties needs to apply to court for a Clean Break financial order which ends all future claims.

If the house is in joint names she won’t be able to sell it without his consent anyway.
