I have an MPS hearing coming up and I am required to serve the court and other side " a witness statement, limited to 4 pages, which sets out:a) Each party’s updated financial circumstances;b) Whether that party seeks a variation of this maintenance pending suit order and their reasons for doing so."

Can anyone explain how this differs from a position statement and what format it is supposed to be in? Also, as I'm limited to 4 pages how can I include evidence to support my statement? Any help would be greatly appreciated!

A position statement is a witness statement that sets out your position. In an MPS case this will deal with income and outgoings as well as any changes that have happened/are expected imminently. You will need a schedule of outgoings and supporting evidence of any income, including child may and benefits to which you may be entitled.

You would also be expected to summarise the progress of financial settlement.

The other side will need to provide the same information so the court can determine a: your need and b: their ability to pay.
