Hi.

I am a LIP respondent in a financial remedy case. The case has been issued but not served in accordance with the relevant FPR/CPR. The service time limit has ellapsed. I am thinking of using form D11 to make anstrike out application for non commplience with the rules/CPRs. I have read so much that my head is swallen but I am non the wiser.

I can not afford legal help. I welcome advise please.

I am thinking if the claim is struk out then the orders issued from its process that includes a £4000 cost order for not attneding FDA will have to be set aside and the paid fine returned.
