DIY starter help - 1 child/no assets

Hi, want to start DIY divorce and not to involve solicitors unless necessary.

Situation is, separated over 2 years ago, no assets, we have some debts that are being sorted now and hopefully agreed upon before divorce application. We have agreed maintenace on child under 18 so understand this has to be legalised.

So question is what is the proceddure, for instance I have read It’s crucial to make sure you have a binding court order setting out what the financial arrangements are, even if the court order confirms neither of you want to make a claim against the other..

Any help appreciated.

You will need a simple Clean Break order approved by the courts. This will formally end all future claims.
Maintenance for children under 18 is generally handled by CMS but can be included in an order. After 12 months either party can ask for a CMS assessment that woukd supersede this section of the order.
You can apply for the Consent Order once you have a divorce conditional order in place.
It needs to be properly drafted - this site offers a low cost drafting and submission service - and accompanied by a D81 Statement of Financial Information. This sets out your respective financial information so the judge who is asked to approve the Consent Order can see it is fair to both of you.
You can book a fixed price legal financial consultation to check that what you propose will be seen as fair by a judge.
