Could anyone clarify which solicitor is responsible for competently drafting a contested Consent Order? Is it my solicitor, as I was the applicant for the financial order,or is it that both solicitors are responsible for competently drafting an order and ensuring the relevant terms are included . My solicitor advises neither solicitor noticed the problem when completing the consent order. This has caused a lot of ongoing problems.

Generally if a party makes an offer which is accepted, they would normally have a draft order to encapsulate that settlement. The parties can then fine tune the order.

It sounds like there is more to it though as a consent order is by its very definition uncontested. What seems to be the problem that makes it contested?

well I filed for court as he would not agree to anything - but did so standing outside the Judges room at court - so I suppose it was contested then converted to a consent order on the day of court hearing
