What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Could anyone answer a few quick questions please:

We both have defined contribution pensions and have logged into our online accounts to see the pot values. Wife's is £5,599, Husbands is £25,110. Are these the correct figures to use when working out pension offsetting?

Wife owns a car outright, where is best to get the value to use for this as an asset?

Husband has a car on a pcp loan and is only 1 year into a 4 year term. The total current liability is £13,102 (7,197 in monthly payments and the final lump of 5,905 to own the car), we believe the car when owned will be valued at 10k. What figure should be used when calculating the financial split? Is it simply a liability of £13,102 or is the liability only £3,102?

Thank you

Yes, if pensions are DC use those figures. If offsetting bear in mind you won’t be able to access the money until age 55/57 and it is taxable.

For PCP car use the figure you would get if you handed it in today, likely to be zero.

For other car just search on line at We Buy Any Car or similar.
