Hi I got divorced in 2012 after a very acrimonious divorce I was married to a financially controlling person. I was issued a court order for child and spousal maintenance after extortionate legal fees amounting to over £100k I looked after the children at home. I had no earning capacity at the time and was unable to obtain a mortgage. He was paying child maintenance over the years every so often he would message me saying g he would be deducting my money I would then message him back saying it would put me in financial difficulty if he keeps reducing it I never received a reply. He remarried after divorcing me after 5 years has 2 children now. He has always been on £140k a year. He has no regard to my wellbeing or his children. My youngest son turned 18 2 years ago it was then that I turned to a solicitor for advice to go back to court. I am a victim of domestic abuse and I was able to get legal aid. Proceeding began over a year ago. After numerous attempts to say he owes me spousal maintenance he has kept saying it was agreed how much he would pay me, it was never agreed I had no choice in the matter. My solicitor decided to enforce arrears on that very same day he decided to put in an application to discharge my order !!!!! My solicitor had a response from my ex husband today stating he denies any arrears have occurred he has never put in an order to vary it or discard it until I made the application for enforcement of arrears. I have said to solicitor why I hadn't took him back to court before now because I was pyscholicslly damaged from all the control and manipulation. He had over me.
I do not understand what makes him think he doesn't owe me anything he has never paid me spousal maintenance it is black and white. I have all the statements from payments made from 2012. Aby comments grateful. Vanessa
