Hi

In the final stages of agreeing a Clean Break order w my ex.

I will be keeping the majoirty of our shared debt (£14k ish), they'll keep the savings pot we had £7k, and taking ownership of our shared vehicle (£700 valuation).

To avoid a pension sharing agreement i'm offering to pay more child mainintance. The over all difference in our total assets is £5k- the extra CMS i'll pay will be equal to this.

I'm currently working on a high salary- while she is unemployed (doing masters, may have PT work soon).

We want to avoid lawyers as we have very little assets and quite a simple case.

Just want to make sure i'm not crazy by agreeing to pay this difference (roughly £200 P/M for 2 years?)

From her point of view what’s to stop you from changing to CMS assessment?

What makes you think there will be pension sharing involved?

There is already a CMS arrangement in place. Apparently due to our difference in income the court may see it as uneuqal on a monthly basis and reject the clean break.

She suggested the PSA but i'd like to avoid losing money from my pension, so compromising by her keeping savings car + no debt. This is a on going negotiation- hard to gauge if this feels 'fair' or not.

The more I type the more I think this is a question I need to answer myself!
