Hi all, I am contemplating divorce after 5 years together. My ex has 2 kids from a previous marriage (16 and 15), which the previous parent pays maintenance for.

Can anyone tell me how the kids are factored into our divorce settlement?

They are counted as 'children of the marriage' and taken into account when your stbx's housing needs are assessed.

Thanks for the confirmation, and what I was understanding. Would this mean that I would have to provide for them as they are already being supported by the ex's ex?

You wouldn't have to pay child maintenance but her housing needs count as greater at least until the children are older.

Thanks for confirming. :-)It is an absolute nightmare trying to find info. I sold my home and moved in with my partner, invested a lot of money into their house to bring it up to date. Now feeling like I am going to lose the lot and be left homeless and penniless as it is their name on the mortgage.

You can register matrimonial home rights and seek return of your contributions. It may be that you have to wait for the money though - possibly until the youngest is at least 18.
